TAKE NOTICE that the named Plaintiffs have filed a Complaint in Action to Quiet Title on May 10, 2024 at AD 2024-297 averring the following:
(1) That Plaintiffs, Thomas Andrew Nixon and Kimberly Ann Williams-Nixon, husband and wife, are the owners of the following described premises, to-wit:
ALL that certain piece or parcel of land situate in North Shenango Township, Crawford County, Pennsylvania, and being known as Lot No. 106 of the Colonial Estates Plan of Lots No. 3, a plot or plan of which is duly recorded in the Office of the Recorder of Deeds of Crawford County in Plan Book 5, page 16, said lot being more particularly bounded and described as follows, to-wit:
On the North by Cabot Lane a distance of eighty (80) feet; on the East by Lot No. 107 in said Allotment a distance of one hundred fifty (150) feet; on the South by Lot No. 109 in said Allotment a distance of eighty (80) feet; and on the West by Lot No. 105 in said Allotment a distance of one hundred fifty (150) feet.
SUBJECT TO all of the restrictions as set forth in the Colonial Estates Plan of Lots No. 3, a plot or plan of which is duly recorded in the Office of the Recorder of Deeds of Crawford County in Plan Book 5, page 16.
Bearing Crawford County Assessment No. 4606-033-106 (the “Subject Property”).
(2) That any and all interest of Michael J. Davis, or his successors or assigns, has in the Subject Property is terminated, void, and of no legal affect;
(3) That the Plaintiffs are the sole and exclusive, fee simple owners of the Subject Property not subject to any claim or interest by the Defendant or any successor or assigns;
(4) Plaintiffs aver that, after considerable due diligence, the present whereabouts or existence of the above-named Defendant, or successor and assigns, is unknown to it; and
(5) Plaintiffs have requested the Court to enter a decree that title to the Subject Property is vested in the Plaintiffs, solely, free from any claim of the Defendant, or his successors or assigns and to enjoin the Defendant, or his successors and assigns, from asserting any interest to the Subject Property or from impeaching, denying or in any way attacking Plaintiffs’ exclusive title to the Subject Property.
